

Texas Craft Brewers Need Your Help!
In the 90th Texas Legislature, you have an opportunity to help craft brewers around the state continue to build their businesses, open safe new markets for thirsty Texans to get the products they want, and support cost-effective and sustainable agriculture practices. Not only are these issues logical and in line with Texas’s pro-business ethos, but they would be great steps forward in fixing the Texas Alcoholic Beverage Code for a healthy, modern, and competitive industry.
Hopportunity for Impact:
Texas Craft Beer in the Modern Market
The craft beer industry contributes $5+ billion to the Texas economy and supports over 30,000 jobs in small business, hospitality, and manufacturing sectors. Despite Texas ranking 6th in total craft beer production, it falls to 48th in breweries per capita. This disparity underscores the substantial growth potential within our large, high-population state. However, anticompetitive laws currently restrict small brewers from realizing their full economic impact.
The reality of the market is defined by narrow margins and rising costs for raw materials—a challenge common to all small businesses. Historically, legislative support in creating new market pathways has triggered exponential growth in the craft beer industry, leading to healthier businesses and increased innovation. This legislative session offers an opportunity for these small businesses to compete and keep an industry producing world-class products right here in Texas going strong.
The Proof is in the Pilsner: Modernization Means Growth
Past revisions of the Texas Alcoholic Beverage Code clearly demonstrate its powerful impact, leading to significant growth for small businesses. Below are examples where modest changes have spurred economic growth and enhanced the role of breweries and brewpubs in their communities.
1993: Brewpubs Legalized
By 1993, 41 states allowed for the operation of brewpubs–small, restaurant/taproom focused breweries selling all or a majority of their beer onsite directly to consumers. Pioneering brewers had been working for a few legislative sessions to pass a bill legalizing brewpubs in Texas and they succeeded in 1993 with the passage of HB 1425. The new license allowed brewpubs to brew up to 5,000 bbls of beer annually and sell that beer directly to their customers for enjoyment onsite or to-go. Today there are 250+ brewpubs operating across Texas.
2013: Brewery Taprooms & Brewpub Distribution
A package of 2013 bills supported by the Texas Craft Brewers Guild brought sweeping reform, creating a modern framework for craft beer in Texas. For the first time, brewpubs gained the right to sell their beer outside their own premises—doubling their production cap to 10,000 bbls per year, which could be sold to retailers like grocery stores, convenience stores, bars, and restaurants, including up to 1,000 bbls of self-distribution. Meanwhile, craft breweries producing less than 225,000 bbls of beer annually gained the right to operate an onsite taproom, selling up to 5,000 bbls of beer per year for on-premise consumption. These changes ushered the Texas craft beer scene into the modern age and spurred massive industry growth in the years that followed.
2019: Beer-To-Go & Sunset Modernizations
The 2019 legislative session marked another milestone for Texas craft beer with the legalization of beer-to-go sales from breweries. This reform allowed customers to purchase beer directly from breweries to take home, fostering greater accessibility and consumer choice. It was a significant step forward in aligning Texas with all 49 other states that already permitted such sales. Beer-to-go passed as an ammendment to 2019’s TABC Sunset bill which streamlined brewery licenses and introduced commonsense updates to the Alcoholic Beverage Code. To-go sales were a particular lifeline to breweries forced to close their doors to on-site guests during the COVID-19 pandemic.

This coming session is an opportunity for the Texas Legislature to expand rights for Texas Brewers and grow our state’s craft beer industry. Please join us in supporting bills that would open new paths to market, cut unnecessary red tape around the movement of products between commonly owned locations, and lower the tax burden of small businesses who are supporting Texas Ag producers.

Beer To You : Open New Paths to Market for Small Businesses
75% of all consumer spending on food and beverage occurs off-premise through channels like delivery, pickup, carryout, and drive-thrus. Yet, breweries are currently prohibited from shipping or delivering their products directly to consumers, unlike their retail and winery counterparts. When we open new market paths for small businesses in Texas, we witness growth. Following the legalization of taproom sales in 2013 and to-go sales in 2019, we observed massive growth. Additionally, these privileges helped save numerous breweries during the COVID-19 pandemic. Now, you have the opportunity to open new market paths for an industry grappling with the impacts of pandemic fallout and rising inflation.
Interfacility Transfer: Cut Red Tape for Brewers to Move Their Own Products
Texas brewers are increasingly adopting a multiple-location business model, but they consistently encounter a major hurdle: moving their own products. To support growth, we need to facilitate the ability for these businesses to transfer products between commonly owned and managed locations without bureaucratic red tape or government-mandated middlemen.
The Beers for Steers: Support Texas Beer and Texas Agriculture
This Legislation would ensure that millions of pounds of free animal feed and compost base does not go to waste, all the while providing a tax break to small businesses across the state of Texas.
